Payment & Fees Terms & Conditions
- The contracting party agrees to pay a booking deposit of 75% of total invoice value at the time of booking and the remaining 25% balance on presentation of an appropriate invoice approximately 1 week prior to the event. For bookings made within one week of an event the total event fee will be due on confirmation of the booking
- Once the quote is accepted & before the contract is awarded to us, we shall send across our MOU which will include all the working terms and conditions of the contract
- Invoices for extras shall be payable no later than 14 days following the date in which the invoice is dated. All extras will incur a 10% administration charge
- As Event Speciale is acting as an agent of (Client Party) in relation to the provision of the service, it will not be liable to any third party suppliers for payment
- Event Speciale will not be responsible for the performance of the third party suppliers or their adherence to the statement of requirement
- If for any reason, any event is cancelled or rescheduled, the client shall be liable to make any due payments to the third parties
- If cancellation 30 days or more than 30 days from the scheduled date of event, no retentions will be charged
- If cancellation between from 15 upto 30 days from the scheduled date of event, 50% retention of contracted amount will be charged
- If cancellation 14 days or more than 14 days from the scheduled date of event, 75% retention of contracted amount will be charged
- Event Speciale will ensure that any price change is communicated to the client through a written/email notification as soon as possible
- The Client shall notify Event Speciale of a disputed amount within 5 days of the date of invoice or request for payment
- The calculation of the Quoted Prices is based on a number of factors. We realize, however, that your requirements may change from time to time, sometimes at short notice and these will constitute a change of, or addition to, the terms agreed by you (and so do not give rise to any right for you to cancel without penalty). We will do what we reasonably can to carry out any changes in, or additions to, your requirements but we must reserve the right at any time to pass on all the costs of such charges and our arranging them for you by charging you for these and to levy the altered charge as an additional fee. Any items specifically not mentioned in this quote would be charged extra as per specification
- VENUE charges would be on actual as per venue selected infrastructure and certain arrangements will change as per venue finally selected
- The rates for all performers / artists are approximate and depend on their availability
- Event Speciale reserves the right by giving notice to the Client at any time before delivery to increase the price of the Services to reflect any increase in the cost to Event Speciale which is due to any factor beyond the control of Event Speciale (such as but without limitation foreign exchange fluctuation, alteration of duties, significant increase in the costs of labour materials or other costs) and any change in delivery dates delivery locations quantities or specifications for the Services which is requested by the Client or any delay caused by an instruction of the Client or failure of the Client to give Event Speciale adequate information or instructions
- Event Speciale is registered under the MSMED act 2006 and is holding “Entrepreneurs Memorandum No.: 270252200708” and liable to charge interest on delayed payments as per the MSMED act 2006, Chapter V section 16 & 17 under the subject “Delayed Payments to Micro and Small Enterprise.” It may be pertinent to note that as per this section, notwithstanding anything contained in any agreement between the parties or in any law for the time being in force, Event Speciale will be liable to charge compound interest with monthly rests from the due date at three times of the bank rate notified by the Reserve Bank of India
- As a policy, we do not provide supporting bills/receipts/invoices for any of the line item mentioned in the quote
- TDS applicable in our line of business is 1%, as per 194C of The Income Tax Act and the amendment as per Finance act of 2011
- GST would be applicable on the final bill amount @ 18%
Ticketed Shows Terms & Conditions
- Tickets once booked cannot be exchanged or refunded or cancelled or transferred under any circumstances. In the case of overlapping of seat numbers, organizer holds the right to adjust seats as per availability
- Any Card Holder found intoxicated/inebriated state of found creating ruckus during the show will be asked to leave. No refund or compensation shall be granted
- Internet handling fee per ticket may be levied. Please check your total amount before payment
- In case tickets are purchased online, patrons must carry a valid photo identification to redeem tickets at the box office. Valid email ID which can be verified must be submitted at the time of ticket purchase online. Carrying a printout of the tickets purchased online is a must. No third party collection allowed, unless accompanied by an authorization letter issued by the Purchaser
- Entry will be refused if the tickets are not purchased from authorized point of sale. The resale of tickets is strictly prohibited
- Once the ticket is purchased, no upgrade to a different section of the auditorium is permitted. If a Card Holder wishes to upgrade oneself, then, a fresh ticket will have to be purchased and there will be no refund of the previously bought ticket
- This Ticket is not valid for entry if the security features embedded/printed on it are tampered. Wristband removed or tampered with, will render it invalid and WILL NOT be replaced. The venue or organizers shall not be liable for any difficulties caused by an unauthorized duplication/copy or reproduction of the ticket
- Organizers do not take responsibility for the loss or theft of any personal belongings or any injury that the Card Holder may incur at the event. The Card Holder assumes all risk associated with attending the said event, including but not limited to happenings during, prior to or after the said show resulting in loss of life, personal injury or damage
- The Organizer reserves the right to frisk the Card Holders at the entry points for security reasons. Your co-operation is required
- Carrying of liquid, alcohol, cigarettes, banned substances including outside food, Firearms, sharp objects, inflammable material, bottles, cameras, cans, laser lights or tins are not allowed inside the auditorium, if any Card Holder is in possession of any of these items, they shall be confiscated or the Card Holder should voluntarily deposite the items at the entrance to the Auditorium. However, The organizer shall not be responsible for the security or any loss or damage to these items at the entrance
- Organizers reserve the right to video-record and photograph the show. You waive all rights of any nature whatsoever, towards the use of your images/photographs/visuals upon you purchasing the said Ticket. The Organizer may use your image or likeness in any live or recorded video display, photograph or picture
- Paid parking if available at the venue and shall be subject to availability on purely first-serve basis. Parking at owner’s risk. Organizers won’t be held responsible for the vehicle or its content’s loss or damage
- The ticket is issued according to the rules and regulations of the organisers and Management of the venue
- Organizers may postponed, cancel, interrupt or stop of the show due to adverse weather, dangerous situations or any other causes beyond their reasonable control. The Organizers hold the right to change the time or place of the event/show without prior notice. ALL RIGHTS RESERVED
- The rights of admission are reserved with organisers, even for valid Card Holders
Terms and Conditions for Encore Academy of Performing Arts:
- Enrollment and Registration: Enrollment in Encore Academy of Performing Arts classes and programs is subject to availability and requires submission of completed registration forms and payment of all required fees. Encore Academy of Performing Arts reserves the right to refuse enrollment to any student for any reason.
- Fees and Payment: All tuition and fees are due in full by the designated due date. Late payments are subject to a late fee. Encore Academy of Performing Arts reserves the right to deny access to classes and programs to any student with an outstanding balance. All payments are non-refundable, except in the event of a medical or family emergency.
- Attendance: Regular attendance is required for all classes and programs. Students must notify Encore Academy of Performing Arts in advance of any anticipated absences. Excessive absences may result in dismissal from the class or program.
- Behavior and Conduct: Students are expected to behave in a professional and respectful manner at all times, including toward instructors, staff, and other students. Students who engage in disruptive or inappropriate behavior may be dismissed from classes or programs.
- Dress Code: Students must adhere to the dress code established for each class or program. Failure to adhere to the dress code may result in dismissal from class.
- Health and Safety: Encore Academy of Performing Arts prioritizes the health and safety of our students. Students must disclose any health conditions or physical limitations that may affect their participation in classes or programs. Encore Academy of Performing Arts reserves the right to dismiss any student who poses a health or safety risk to themselves or others.
- Liability and Responsibility: Encore Academy of Performing Arts is not liable for any injuries, losses, or damages incurred during classes or programs. By enrolling in Encore Academy of Performing Arts classes or programs, students assume all risks and responsibilities associated with their participation.
- Photography and Video: Encore Academy of Performing Arts reserves the right to photograph and/or video record classes and programs for promotional purposes. By enrolling in classes or programs, students and their parents or guardians consent to the use of their image in such materials.
- Communication: Encore Academy of Performing Arts communicates with students and their parents or guardians primarily via email. It is the responsibility of students and their parents or guardians to regularly check their email and respond promptly to any communications from Encore Academy of Performing Arts.
- Termination and Refund Policy: Encore Academy of Performing Arts reserves the right to terminate enrollment in classes or programs for any reason. Refunds will only be granted in the event of a medical or family emergency, as determined by Encore Academy of Performing Arts.
- Force Majeure: Encore Academy of Performing Arts is not liable for any cancellations or delays resulting from force majeure events, including but not limited to natural disasters, pandemics, or government-imposed restrictions.
By agreeing to these terms and conditions, students and their parents or guardians acknowledge that they have read and understand the policies and procedures of Encore Academy of Performing Arts, and agree to abide by them. Encore Academy of Performing Arts reserves the right to modify these terms and conditions at any time.
